The presentation covers various ways to protect software innovations in the United States including patents, copyrights, trade secrets, and trademarks. The primary focus is how an international company should use the U.S. patent systems to protect software today. Also discussed are the new standards used in the U.S. to determine whether software and business methods are patentable subject matter and how the newly enacted patent reform law will affect software protection in the future. Time permitting, other important aspects of the patent reform law (such as first to file, post-grant opposition, dropping best mode requirement, etc.) will be addressed.
Robert Lord is a partner of OSHALIANG LLP. Mr. Lord's practice focuses on patent prosecution, portfolio management, client counseling, licensing, and litigation in the fields of software engineering, business methods, and computer engineering.
